Compulsory Purchase Orders
The team acts both for acquiring authorities and those affected by compulsory purchase orders (CPO). The team deals with all aspects of the process from land scheduling to making the orders and taking it through the public inquiry process as well as handling compensation issues through to the Lands Tribunal. It also negotiates both development agreements and compensation indemnity agreements relating to compulsory purchase schemes. Examples of our work include:
- Acting for South Oxfordshire District Council on a town centre redevelopment scheme, negotiating the development agreement and s106 agreement, promoting the compulsory purchase order and pursuing it through public inquiry: dealing with compensation claims including references of claims to the Lands Tribunal;
- Promoting for Bristol City Council a City Regeneration Compulsory Purchase Order at Symes Avenue: making and securing compensation of the Order and advising on CPO compensation claims;
- Opposing a city centre redevelopment scheme at Plymouth on behalf of affected owners including the Plymouth & South West Co-Operative Society Limited;
- Acting for businesses affected by the Olympics Compulsory Purchase Order and negotiating compensation agreements.
- Advising on a major compensation settlement and reconstitution of rights within an industrial estate set by the current tenant Rail Link
- Advising on over £100 million worth of real estate in terms of compensation claims and relocation properties on the London 2012 Olympics scheme including the first Lands Tribunal reference
- Advising several major landowners affected by the Crossrail and Thameslink 2000 schemes
- Advising on a 21 kilometre underground cable run for a Round 2 Offshore Windfarm scheme
- Advising a gas transporter on an underground gas storage scheme
