David is a partner specialising in liability risks.
David's experience covers employers' and public liability, motor claims and criminal and HSE prosecution work. He has handled high risk portfolios and managed the insured client relationships where large deductibles were involved. He has acted for insurers, claims handling agencies, police authorities, and local authorities.
David now deals exclusively with large loss and catastrophic claims, including brain injury, spinal cord injury, amputee cases and fatalities. He advises major insurers on the complexities of these types of cases and works closely with all parties to the claim to bring matters to a resolution. He also particularly enjoys advocacy, whenever the opportunity arises.
Examples of experience include:
- Painting v University of Oxford, 2005 - obtaining a costs order against a claimant who had exaggerated her claim, on the basis of the principle that the defendant had won the real issue in the case even though the Part 36 offer had been beaten
- McMinn v McMinn & Aioi Insurance, 2008 - successfully obtaining a judgment that the motor insurer was entitled to avoid liability under the Road Traffic Act in a catastrophic injury claim valued in excess of £1m
- 2008 - advising insurers in a complex multi-million pound residential care case where the claimant suffered injuries of the utmost severity
- 2009 - settling a catastrophic case with a value in excess of £7m at £4.5m, representing a substantial saving to insurers and reinsurers
- 2010 - settling a number of catastrophic head injury cases by way of periodic payment.
In addition, David is an author of the twelfth edition of Bingham & Berrymans' Personal Injury Claims Cases, a leading textbook on personal injury and procedure; he contributes to New Law Journal; and he has written a paper for a course in Advanced Road Traffic Litigation for BPP, the national training organisation. David is also a panel speaker for Jordans Legal Publishing, and has spoken at Post Magazine events.
