Emily is a partner specialising in construction and professional indemnity law.
She has advised insurers and all sides of the construction industry (employers, contractors, subcontractors and suppliers) on a wide range of construction disputes and has pursued and defended claims for extensions of time, negligence, fees and defective works. She has worked on arbitrations (both domestic and international), court proceedings and adjudications. She has also represented clients at mediations.
Her recent experience includes:
Oil and gas disputes:
- acting on behalf of a contractor in relation to an LNG terminal, claim concerned the unlawful withholding of documents
- acting on behalf of a main contractor and defending a substantial claim for disruption on an LNG facility
- successfully defending a contractor in an LCIA arbitration brought by a Middle Eastern oil company concerning equipment at a Condensate Recovery Unit in an oil field in Kuwait
Construction:
- acting on behalf of a European contractor in relation to claims on a road project in Africa
- acting as the solicitor advocate on Linnett v Halliwells LLP [2009] EWHC 319 TCC concerning liability for payment of adjudicator's fees
- acting on behalf of a contractor in respect of a claim arising out of an termination of a contract on a waste water treatment facility in the Middle East
- dealing with a series of adjudications on Extensions of time, variations and loss an expense in respect of a university building
Professional indemnity:
- successfully defending Halcrow Gilbert Associates who were appointed as consultant engineer at a state of the art firefighter training facility, London Fire and Emergency Planning Authority (LFEPA) v Halcrow Gilbert Associates Ltd [2007] EWHC 2546 (TCC) (31 July 2007)
- acting for insurers and the insured consulting engineer in respect of a cooling system in a commercial property in London
- defending a firm of quantity surveyors in respect of alleged negligence in valuations (both at interim valuation and final account stage) and reporting to its Insurers.
Emily has worked extensively with Greek lawyers on behalf of English insurers who have insured risks in Greece. She is currently assisting in defending a number of claims in the Greek courts and reporting to insurers.
Emily was named as an "Associate to Watch" in the 2007, 2008, 2009 and 2010 editions of Chambers UK, the most recent of which says that she "continues to impress with her depth of knowledge and her responsiveness" (2010).
