The Regulations aim to provide agency workers with additional rights:

  • access to a hirer's facilities from day 1 of the assignment
  • the right to know about permanent vacancies from day 1
  • after 12 weeks of an assignment, equivalent pay, working time, holidays, rest periods and breaks to permanent employees
  • after 12 weeks, rights in respect of health and safety and time off for ante-natal care for pregnant workers
Employers need to plan carefully to ensure that they comply with the new Regulations, which include comprehensive anti-avoidance provisions. However, as long as they are prepared, they can still have the benefits of a flexible workforce.
