I recently gave a lecture at the Autumn Arbrix Conference attended by many Arbitrators and Adjudicators. We covered some of the key cases handed down since March that are relevant to all sides of the construction industry and its insurers, notably the Supreme Court decision on immunity of experts, which has caused much stir in the industry as experts can now potentially face professional negligence claims. We also referred to some of the decisions by the Courts on adjudication and the decision in Jet2.com v Blackpool Airport, which deals with best and reasonable endeavours, obligations frequently found in construction contracts.
