We have successfully advised Capita Alternative Fund Services (Guernsey) Limited (Capita) and Matrix-Securities Limited (Matrix) in their claim against Drivers Jones, in which judgment was handed down on 9 September 2011. Capita and Matrix's claim was in relation to Drivers Jonas' valuation and investment advice on Capita's acquisition of a factory outlet centre in Chatham, Kent in April 2001. Capita and Matrix were advised by a team led by dispute resolution partner Anna Maxwell, associate Victoria Brooks and others. The Judge upheld Capita and Matrix's claim, finding that Drivers Jonas had acted incompetently and in breach of contract and in breach of its duty of care in the valuation and advice it provided.

The Court found that Dockside had been significantly overvalued, by £18.05m, and ordered that Drivers Jonas pay this sum to Capita by way of damages, together with interest from 5 April 2001. Damages together with interest gives rise to an overall sum of at least £26,550,000.  Drivers Jonas have said they will appeal.
