We advise on the retail distribution of financial services products and have particular expertise in FSA regulation and the documentation, promotion and distribution of retail financial services products including consumer credit.  We offer sound and pragmatic advice on legal and compliance issues at the heart of our client's businesses - arising under the Financial Services and Markets Act 2000, the FSA Handbook, the Payment Services Regulations, the Consumer Credit Act 1974, and in relation to E-Money. 

We focus on minimising the risks of regulatory intervention by delivering commercially sensitive and focused advice.

Our work

  • advising clients including the UK entity of a large international corporation in relation to FSA permissions required and assisting with their applications for authorisation 
    •  
  • acting for Post Office on the launch of several new products including ISAs, mortgages and business insurance
  • advising LV= in connection with the drafting of the terms of its new equity release mortgage documentation
  • drafting the current customer facing terms for a new Bank Deposit Account and Cash ISA.  In particular, this involved reviewing the current structure of the products and implementing recommendations on how to simplify the products for customers
  • analysing the regulatory treatment of a charitable giving service and, flowing from that, drafting terms applicable to Charities and, Donors and Fundraisers.  We also supported the giving service after launch by helping establish the relationship with business partners under a credit card cash back scheme
  • advising upon the impact of the Payment Services Regulations 2009 on the Post Office's activities, and on a Bank's product range
