Our environmental team's expertise lies in the fields of environmental liabilities, contaminated land, environmental assessment and nature conservation, waste and environmental compliance and risk management.  Our approach to provide proactive and practical advice which focuses upon the importance of working closely with clients to know their businesses and working with them on compliance, sustainability, the continual improvement of environmental standards and protecting brand reputation.

As part of this we developed a bespoke web-based environmental law compliance resource, which can be combined with the team's critical incident policies, provides a means of minimising risks, planning for compliance investment, protecting brand reputation and, increasingly, supporting sustainable business objectives: environmental law in its manifest forms is a force for change in business practices. 

Our Work

  • Competent Authority (Health and Safety Executive & Environment Agency): advising on the investigation from its outset, progressed the case through to prosecution of five companies subsequent to the Buncefield Oil Terminal explosion.  In July 2010, a total of £9.4 million in fines and costs was imposed on the five defendant companies following an 8 week trial.  The team's role in managing the case was recognised as a significant factor in the Health and Safety Executive and Environment Agency being awarded the Attorney General's Prosecution Team of the Year
  • Smiths (Gloucester) Limited, Smiths (Quarry Operations) Limited and Alan Smith.  EA prosecution against two companies and an individual director relating to volume of inert material imported into quarry as part of restoration scheme. The case involved advising on Environmental Protection Act 1990, Proceeds of Crime Act 2002, conditions and exemptions of Environmental Permit and terms of planning consent
  • Eneco Round 3 Development Limited. Development of offshore wind array, known as the Eneco wind park, located to the west of the Isle of Wight.  The project is one of the 9 "Round 3" offshore wind schemes promoted by The Crown Estate.  The total project costs are likely to be in excess of £1.5bn.  The matter involves diverse and complex issues including impacts on navigation, visual impact (in particular from a World Heritage Coastline), impacts on recreational sailing and dealing with competing uses of the sea
  • East Anglia Offshore Wind Limited (ScottishPower and Vattenfall joint venture) on the development of the East Anglia Round 3 Offshore Wind Farm zone, including consenting, real estate, grid and other aspects.  The consenting involves advice on the obtaining of a development consent order from the IPC
  • Veolia Environmental Services.  Review of the planning application, preparing for public inquiry following call in by Secretary of State and conduct of the inquiry, for a major waste to energy plant in Nottinghamshire to form a key part of Veolia's waste management strategy for the county
  • Wales & West Utilities Ltd on contaminated land issues arising in respect of several sites within the portfolio of properties purchased from National Grid and comprising former gas works.
