Employment Claims

We have experience of dealing with a significant number of claims across the UK, including Scotland and Northern Ireland.  (For example, we have handled in excess of 150 claims at any one time for one particular client.)  The team includes experienced advocates, enabling us to provide a seamless advisory and advocacy service in Tribunal claims.

Our commercial and proactive approach ensures an increase in the withdrawal rates of Employment Tribunal cases.  Having monitored our withdrawal rates on cases for key clients from inception of new work, we are confident that our strategic and tactical approach to Employment Tribunal cases secures a high withdrawal rate.  We believe that this approach not only helps to control direct legal spend but also reduces lost management time on case.

Our work

  • Royal Devon and Exeter NHS Foundation Trust - defending a complex and very high profile religious discrimination claim (a nurse crucifix case), which dealt with further test points around indirect discrimination.  It attracted national news coverage, as well as considerable interest from the legal community.  The team obtained a costs order, headed off a threatened appeal and assisted the client with managing the attendant PR
  • Thetrainline.com Ltd - acting for the company and one of its group companies in defending them against a high value and complex multi-party claim brought by a trade union and two individuals for alleged failure to inform and consult on a TUPE transfer following the insourcing of a service and subsequent reorganisation, as well as two associated individual claims for unfair dismissal
  • CommScope Inc - advising this multi-national on a wide range of employment law issues, particularly in relation to its Scandinavian operation, as well as the UK (including the enforcement of a US confidentiality agreement against an EU sales manager)
  • Ordnance Survey - advising on the employment issues associated with its decision to outsource its print and warehousing functions, including advice on TUPE and redundancy issues and complex consultation requirements and negotiating detailed indemnities within the transfer documentation
  • Portland Business & Financial Solutions - defending an action from redundant ex-employees for a failure to consult collectively, which was brought following the liquidation of a large international engineering company
  • Advising the in-house legal team of a large financial services group in relation to the outsourcing of its global IT function with TUPE implications and potential redundancies
  • Advising a client on the outsourcing of its UK distribution and logistics function.
