Our team is focused on understanding what is required by the European Directives that govern the public sector and utilities tendering for works, services or supplies.
 
We work with clients through the process of a regulated tender by drafting documents such as the OJEU notice, the pre-qualification questionnaire and the invitation to tender (invitation to negotiate or invitation to take part in a competitive dialogue process), helping clients to devise transparent scoring systems, assisting in how to structure the negotiation or dialogue phases and dealing with debriefing issues. We can also advise on specialist IT procurement.

We have an excellent track record of working with clients in delivering projects procured using the competitive dialogue procedure.

Our work

  • South West Public Transport Information (t/a Traveline South West) conducted a tender process using the competitive dialogue process to meet their requirement for a data creation and journey planner system and subsequent maintenance of that system to deliver data and journey planning functionality for the Traveline South West service
  • our team was sole legal adviser assisting on all aspects of the procurement, including structuring the competitive dialogue process to achieve maximum benefit and drafting the contract terms
  • the legal advice and support combined a real understanding of the ways to use the competitive dialogue process to explore the options available in the market with an in-depth understanding of IT procurements. The process completed in the summer of 2010
  • South West Regional Development Agency The firm was retained as legal adviser on the construction of the totally unique offshore wave hub project. Amongst the issues that we advised on were the Development Agency’s obligations under the Public Contracts Regulations when tendering the various contracts that were let for the onshore and offshore work
  • English Heritage - during 2010 we acted for English Heritage on a procurement process for ICT support services across the whole of the organisation using the competitive dialogue procedure.  The OJEU notice was published in February 2010 and the contract was awarded on 2 November 2010
  • Royal Mail Group Limited/Post Office Limited – we act on an ongoing basis for both Royal Mail Group Limited and Post Office Limited doing compliance checks on documentation for their regulated tender processes.
